DEFINITIONS

“Afflatus Logic” refers to the operator of the Afflatus Logic Discord server and all affiliated entities, systems, bots, automation, analytics, and services. “Service” refers to all content, research, analytics, charts, alerts, automation, communications, and functionality made available through the Afflatus Logic Discord server or related systems. “User” refers to any individual or entity that accesses, views, or interacts with the Service. “Agreement” refers to this Master Service Agreement & Risk Disclosure, including any updates or modifications. “Market Data” refers to price, volume, or trade-related information originating from exchanges or data vendors.

IMPORTANT NOTICE

This Master Service Agreement (“Agreement”) is publicly available prior to access at https://afflatuslogic.com/msa and is required to be accepted as a condition of accessing the Afflatus Logic Discord server.

By affirmatively indicating acceptance through the Discord server rules, onboarding, or access interface and accessing or continuing to access the Afflatus Logic Discord server, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. Continued access or use of the server constitutes ongoing acceptance of these terms.

In the event of any discrepancy, conflict, or ambiguity between versions, the publicly hosted version of this Agreement shall control.

SECTION I — SERVICE NATURE & LIMITATIONS

1. NOT A SIGNAL OR TRADE SERVICE

Afflatus Logic is a quantitative research and market analysis publisher.

No Trade Commands

We do not issue buy, sell, hold, enter, exit, or trade instructions of any kind.

Descriptive Only

All outputs — including charts, alerts, probabilities, commentary, and automated messages — are descriptive observations of market behavior and not directives.

Automation Safe-Harbor

All automated systems are constrained to descriptive, probabilistic, and observational language. Any unintended phrasing shall be interpreted consistent with this Agreement and not as a directive or recommendation.

You alone are responsible for all trading decisions.

2. NOT A MARKET DATA PROVIDER

Afflatus Logic is not a licensed distributor of market data (CME, NYSE, NASDAQ, etc.).

Derived Analysis Only

All visuals and analytics are derivative works — mathematical transformations applied to market data.

No Execution Use

This service may not be used as a price feed or execution reference. Users must maintain their own compliant, real-time market data subscriptions via a broker or licensed data provider.

3. NOT FINANCIAL ADVISORS

Afflatus Logic provides impersonal market commentary only.

We do not know your financial situation, risk tolerance, or investment objectives.

Nothing within this server constitutes personalized, fiduciary, legal, or financial advice.

SECTION II — RISK DISCLOSURES

1. Hypothetical & Simulated Performance

All models, analytics, probabilities, “edges,” backtests, or historical examples are hypothetical.

CFTC Rule 4.41 Disclosure:

Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Since trades have not been executed, results may have under- or over-compensated for market factors such as liquidity. Past performance is not indicative of future results.

2. High-Risk Warning (Futures & Leverage)

Trading futures, options, leveraged products, or derivatives involves substantial risk of loss.

Leverage can magnify gains and losses.

You may lose more than your initial investment.

Risk Capital Definition:

Only capital that can be lost without impacting financial security or lifestyle should be used for trading.

3. No Guarantees

Markets are uncertain.

No system, model, analysis, probability, or framework can predict future outcomes with certainty.

4. No Reliance Clause

Users acknowledge that they may not rely on any information provided within this server as the sole basis for any financial or trading decision.

SECTION III — INTELLECTUAL PROPERTY (IP)

1. Proprietary Technology

All content within this server — including but not limited to algorithms, analytical logic, “Edge Packs,” probabilistic models, custom indicators, Pine Script, Python code, charts, visualizations, and automation outputs — are the exclusive intellectual property of Afflatus Logic.

2. Anti-Leak & Anti-Reverse-Engineering Policy

SECTION IV — COMMUNITY CONDUCT

1. Illegal Activity — Zero Tolerance

The following are strictly prohibited:

Violations result in immediate removal and potential reporting.

2. No Solicitation / No Poaching

Do not DM members to sell services, manage accounts, promote courses, or advertise external communities.

Violations result in an instant ban.

3. Respect & Conduct

Harassment, hate speech, toxicity, or disruptive behavior is not tolerated.

Afflatus Logic reserves the right to remove any member at its sole discretion.

SECTION V — ELIGIBILITY & ACCESS

1. Age Requirement

This server is strictly 18+.

By joining, you certify that you are at least 18 years old and legally capable of entering this Agreement. If a user is discovered to be under 18, access will be revoked immediately.

2. Subscription & Access Control

Access is managed automatically via Whop or equivalent systems.

Expired or failed subscriptions result in automatic role removal.

Afflatus Logic is not responsible for access interruptions due to payment issues.

SECTION VI — MODIFICATION & TERMINATION

Afflatus Logic may update these terms at any time.

Continued access constitutes acceptance of revised terms.

Access may be revoked at any time without notice.

SECTION VII — LIMITATION OF LIABILITY

To the maximum extent permitted by law, Afflatus Logic shall not be liable for any direct, indirect, incidental, consequential, or financial losses arising from the use of this service.

SECTION VIII — GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the United States and the state in which Afflatus Logic is registered. Any disputes shall be resolved exclusively in the state or federal courts of that jurisdiction.

SECTION IX — NO WARRANTIES

The Service is provided on an “as is” and “as available” basis. Afflatus Logic makes no representations or warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, availability, or fitness for any particular purpose.

SECTION X — INDEMNIFICATION

Users agree to indemnify and hold harmless Afflatus Logic, its operators, affiliates, and partners from and against any claims, losses, damages, liabilities, costs, or expenses arising out of or related to misuse of the Service, violation of this Agreement, or violation of applicable laws or regulations.

SECTION XI — SEVERABILITY

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

SECTION XII — FORCE MAJEURE

Afflatus Logic shall not be liable for any delay, interruption, or failure to perform resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, network failures, platform outages, labor disputes, or third-party service disruptions.
